The owner of the brand Berto Salotti - Manufacturers of comfort - and of the site www.bertosalotti.it is FBS LTD, a company registered in the register of companies at Monza number MB-1865554, established in Meda (Monza and Brianza) Via Consorziale dei Boschi 21 - Meda. The fully paid share capital is €. 50000.00.

■ ABOUT PURCHASE
The possible buyer is the person who has turned eighteen and is able to commit contractually.
We believe that the clauses of the Agreement are expressed clearly, so that all persons are able to understand the terms of the Agreement; we are at your disposal for any clarification.

■ WHO BOUGHT FROM
- The seller of the products purchased through electronic transaction (and / or email) is the FBS LTD identified as above.
- The F.B.S. Inc., owner of Marco Berti SALOTTI - Manufacturers of comfort- is a company for design, production, distribution and sale of chairs, sofas and furniture items through its retail outlets, dealers, through Internet and electronic transaction, and its production is known for its quality, finishing touches, the use of quality materials and a continuation of a local tradition that maintains the positive characteristics of a handicraft production.
- It is the will of F.B.S. LTD to have a clear and constructive relationship with its customers and to expand the number of purchasers of the products.

■ WHAT TO BUY
Object of the contract is the purchase of a product FBS LTD Berto Salotti indicated on the site where there are detailed measurements and general characteristics of the product.

■ HOW TO BUY
Orders will be accepted by F.B.S. LTD only if sent via electronic process or by e-mail in the manner indicated below.
To purchase our products please complete fully the electronic order form that can be found at http://www.bertosalotti.it/login.html with acceptance of all conditions of sale therein contained.
Before submitting the order, the purchaser may contact our company to receive clarification and information.
The transmission of the electronic order form commits the buyer to accept and comply with all the General Terms on this page.
The order is accepted upon receipt of the "Order Form" duly completed together with the payment.
If the product selected by the buyer - upon receipt of the order- is no longer available, we will notify the customer with the utmost diligence, which may at his discretion, decide whether to make changes to the order (delivery time, or change models) or request a refund of the deposit that will be paid by bank transfer.
The order form will be filed in the database of the site and you will receive a confirmation in the e-mail inbox you specified in the registration

■ CHANGES TO THE ORDER
Our products are entirely designed and made to order, for this reason the buyer can change the submitted order only in paper form or electronically within 24 hours after the conclusion of the contract.

The prices listed on the site are all inclusive of VAT.
Payment can be made through the site, at the time only by Credit Card.
You can pay by filling out the form for payment by credit card, using all traditional credit cards (Visa, Mastercard, etc.). Including prepaid cards (type Postepay) of Visa electronica (ATM) .
The circuit used is that of Banca Intesa San Paolo, secure and comfortable and your information is handled safely.
Upon payment the amount is only authorized, payment is made later.
You can also decide to acquire the confirmation of the order by phone or by mail with our customer service that will assist you.

■ DELIVERY GOODS - SHIPPING
All shipments are covered by insurance guarantees.
The shipping cost varies according to the volume or weight of packages and is indicated in the cart when selecting products.
Supplements for the cost of shipping (which will be communicated as soon as possible) are possible in case of destination abroad, or particular destinations, such as pedestrian areas, lagoons, small islands, and where the passage of trucks is not possible.
We work with couriers renowned for professionalism and experience. This choice is made to ensure the service level and the product integrity during transport.
The average time for delivery of the selected product is shown in tab.
Each item is prepared for the customer according to his indications and delivery times may vary from 10 days to 60 days depending on the model chosen, fabric (and any other details).
The F.B.S. LTD tries to respect and shorten delivery times indicated, that, however, can not be considered peremptory especially in case of delays of suppliers or beyond their procedure.
Deliveries scheduled in the period around Christmas or summer holidays may be delayed even consistently.
You will be notified by e-mail when the courier collects your goods from our warehouse.
Deliveries are made on weekdays from Monday to Friday.
Deliveries are always at street level. Carriers do not deliver to the floors and withdraw your used.
Since the time of delivery the buyer is required to verify the exact number of packages (as used in the transport document), their condition and integrity.
In case of any damage to packing, the buyer is required to challenge that fact immediately to the carrier writing on the delivery document the words "subject to removal because the packaging has been damaged."
Our products do not require special mounting procedures as pre-assembled and where it is necessary to link the various sessions, the instructions are contained in any accompanying cards.
If the buyer delays in taking delivery of the goods purchased, he will be required to pay only the price agreed for the sale and any interest referred to in art. 7, the storage costs that are contained in €. 5.00 for each day of delay.
If the delay is over 30 days, without providing for the payment, we may, by written notice, consider this contract terminated as of right in which case the purchaser will be required to pay a penalty, an amount 50% of the amount agreed for the sale, in addition to any further damages.

■ PRODUCT WARRANTY
All our products are accompanied by an invoice of sale valid for 24 months warranty on defects, according to Legislative Decree No 206/2005; to take advantage of the warranty the consumer will issue the invoice or receipt that he will receive with the goods purchased.
The above warranty is applied to products with lack of conformity if they are used correctly in accordance with their intended use and maintenance.
Where the products purchased were damaged, the buyer is obliged to formally challenge the damage found, enclosing the photographic documentation.
The F.B.S. LTD will replace the damaged part or the whole product. The damaged piece will be packed again with the original packing and returned to the courier.
Where the application of warranty provides for reimbursement of the product, it is your responsibility to properly pack the parts you must give back in order to avoid damage.
The F.B.S. intervenes as quickly as possible in situations that require repair or replacement of products still under warranty.

■ RIGHT OF WITHDRAWAL
Under Article. 64 of Legislative Decree no. 206/2005 consumer in distance contracts or in contracts negotiated away from business premises (among which are contracts concluded via the Internet or electronic transactions) has the right to cancel the contract without penalty and without specifying the reason within ten working days.
In the contracts at http://www.bertosalotti.it/ however, is applied the derogation in Article. 55, paragraph 2, lett. c, Decree 206/2005, whereby the right of withdrawal is not recognized in the contracts of supply of customized or personalized goods.The right of withdrawal may not be exercised for those products that provide a personal use such as mattresses and pillows in case the protective cellophane is not sealed.
The withdrawal right is exercised by sending, within the limits laid down in paragraph 1 of the law written above, a written notice to the place of FBS LTD Meda by Consorziale dei Boschi, 21 20036 (MB).
The communication can be sent within the same period, by telegram, telex, electronic mail and fax, provided it is confirmed by registered letter with acknowledgment of receipt within forty-eight hours.
The only costs for the right of withdrawal, are the costs of returning the property to our company.
If the withdrawal right is exercised in accordance with the provisions stated herein, the FBS LTD will reimburse the amount paid excluding the costs incurred for shipping.
Repayment will be by bank transfer within fifteen days from the date in which FBS LTD gets to know the bank coordinates of the buyer, however, after the receipt of the goods in our warehouses and the control of the integrity of the product.

■ RESOLUTION OF DISPUTES
Any disputes arising from interpretation or implementation of this Contract will be subdued to the attempt of conciliation under the Rules of the Chamber of Commerce, Industry and Handicrafts of Monza and Brianza.

■ PRIVACY AND PERSONAL DATA (PRIVACY CODE Legislative Decree 196/2003)
Browsing the site does not require registration by the user. To purchase products in the online catalogue http://www.bertosalotti.it, the consumer is required to register personal information strictly necessary for the purchase and delivery of the product.
To the processing of personal data of users of the site http://www.bertosalotti.it, is applied Art. 13 Legislative Decree 196/03 (the Privacy Code). The data will be used by F.B.S. s.r.l in favour of different subjects.
The Owner of the treatment of personal data on persons, identified or identifiable, processed after consultation of our site, is Filippo Berto.
The acquired data are processed electronically in accordance with the laws.
Personal data will be disclosed only to persons inside the company, authorized to carry out activities necessary for the execution of the contract and used exclusively for that purpose.
In no event will the data be disseminated to third parties. The interested party may apply to the Owner of the data to confirm the existence of its own personal data by Meda Consorziale dei Boschi, 21 20036 (MB), to know their origin and the function of their treatment, to ask for the update, the rectification, integration, cancellation and transformation into anonymous form or for the block in case of unlawful processing; he can oppose to their processing for legitimate reasons.
